Background
SPT acts as an umbrella body for the vetting of drivers and/or attendants who are employed on regulated work on behalf of the contractors and Councils for whom it acts as agent.
Contractors are required to submit applications for either PVG Scheme Membership for those who are not PVG Scheme Members or Existing PVG Scheme Applications for those who are already members of the PVG Scheme to Disclosure Scotland via SPT acting in its capacity as an umbrella body.
This provides contractors with the benefit that one PVG Scheme application can be used to obtain clearance for employment in more than one council area. For example, if a contractor has contracts in three council areas, the same application can be used for each council as SPT is acting as agent for the councils.
The alternative is for the contractor to make a separate application to each council for clearance and pay for each application separately. Contractors should note that it is the councils that decide who is suitable for use on schools contracts, not SPT.
Contractors cannot deploy any person on any mainstream school transport contract until they have received formal written notification from SPT of the suitability of the applicant. Doing so may result in the suspension or termination of the contract(s). This is covered in clause 8(a) of SPT’s Conditions of Contract.
Membership of the PVG Scheme does not mean that a person is cleared for use on schools contracts administered by SPT, but is the first part of the process. Individuals will still need to apply for the written clearance issued by SPT through their employers as it is up to each individual Council to determine each individual’s suitability. Each Council will make its own decision independently of other councils and where a contractor operates in more than one Council area, this may result in different decisions for an individual.

How long does it take for a PVG Scheme Application to be processed?
This depends on a number of factors. SPT aims to process Applications as quickly as possible, but has to rely on Disclosure Scotland, The time taken will depend on what checks have to be carried out by Disclosure Scotland. Applications should normally take approximately 14 days to be processed by Disclosure Scotland but there are cases where Disclosure Scotland may carry out further enquiries and this means that it can take longer for the Application to be processed. Details are on the Disclosure Scotland website. If the Application is not filled in correctly, for example, if a complete 5-year address history is not provided, the form will be returned by SPT for correction. Please check that the details on the form are correct before sending it to SPT. If any of the required details are missing, the form will be returned for them to be filled in. If there is any vetting information on the PVG Scheme Record, SPT is then obliged to consult the councils it acts for and this can take another two to three weeks for the councils to make their decisions. In some cases it may take longer.
How much time should I allow for clearance?
Please make sure that you submit your applications in good time, bearing in mind that it can take some time for an application to be processed. Some times of the year are busier than others, for example, in the run up to the Festive season, Disclosure Scotland gets more applications for seasonal workers than at other times of the year and this may affect the time it takes for the issue of a PVG Scheme Record or Scheme Record Update. We recommend that you submit applications at least 8 – 10 weeks before the clearance is required.
I have a clearance from a council. Can I drive on SPT Contracts?
No. You cannot drive on SPT contracts until you have received a letter confirming your clearance.
My drivers and attendants are all cleared through a council. Can I use them on SPT contracts?
You must not use anyone on any SPT contract until you have received written clearance from SPT. If you work within East Renfrewshire, South Lanarkshire and West Dunbartonshire Councils, you can complete a VODA3 form for each person you wish to employ on an SPT contract and submit it to SPT with evidence of the council clearance for each person. You will then be issued with the appropriate clearance. For all other council areas you will need to make an application for a clearance using a PVG Existing PVG Scheme Member Application and a SPT VODA1 form.
How long will it take for a clearance issued by a Council to be transferred from one employer to another?
Please allow up to 10 working days for this.
I have just taken on a driver or attendant who already has a PVG Scheme Record and is cleared by SPT for his/her old employer. Can I use this driver or attendant?
No. You must notify SPT using a VODA4 form requesting transfer of the clearance and wait until you receive written clearance. There is no charge for this. If the driver or attendant was cleared for a different council area, you will not be able to have that clearance transferred and will require to submit an Application for a Scheme Record so that the council can determine the person’s suitability.
How long will it take for a clearance to be transferred from one employer to another?

How much does a PVG Scheme Application cost?
The current price is £59.00 for an application to join the PVG Scheme and £18.00 for a Scheme Record update. These amounts are payable to Disclosure Scotland. See the Disclosure Scotland Website for full details of fees. Fees are set by the Scottish Government and not SPT.
Can my drivers or attendants work on an SPT contract while waiting for their clearance?
No. You must not allow any driver or attendant to work on an SPT contract unless you have written clearance from SPT for each person.
What happens if I use a driver or attendant without SPT clearance?
This will result in a warning letter from SPT and the addition of 5 penalty points to ALL of the contracts held, along with the appropriate financial deduction. It may also result in suspension or termination of the contract.
When completing a PVG Scheme Application, who fills in the details on the page headed “Countersignature”?
This page is completed by SPT. You must not enter any information on this page otherwise the application will be returned to you and you will be required to complete a fresh application.
